Therapist Recruitment Terms & Conditions
The standard package in section 2 is a separate offer. Sections 10–14 govern this new package and override conflicting earlier provisions. The first replacement includes a waiver of both search and success fees. Sections 15–16 apply to both packages for new orders.
Read the new package terms ↓1. Service provided
Nuad Thai School provides a professional therapist search and candidate introduction service. This may include assistance with drafting and improving the job offer; publication and promotion of the vacancy; candidate sourcing and preliminary screening; shortlisting of potentially suitable candidates; massage skills assessment and basic language screening; interview coordination; and assistance with salary, benefits and contract discussions.
Nuad Thai School acts solely as an intermediary. The final hiring decision and employment relationship remain exclusively between the Client and the Candidate.
2. Service fee and online payment
The standard recruitment fee is USD 2,000 per therapist position, divided into a USD 1,000 Recruitment Start Fee per position and a USD 1,000 Success Fee per therapist.
The Recruitment Start Fee is payable before recruitment begins. It covers sourcing and outreach, initial screening, CV and qualification review, candidate communication and follow-up, interview coordination, professional practical massage testing, use of a professional model where applicable, assessment by the trainer and/or recruitment team, video recording of practical assessments where appropriate, and general administrative and recruitment coordination work. Available assessment recordings allow the Employer to evaluate technical skills before making a final decision.
The Recruitment Start Fee is non-refundable because professional work, time and expenses are incurred from the start, whether or not the Employer ultimately selects or hires a Candidate. Recruitment begins only after this fee and sufficient information about the position, employment conditions and candidate requirements have been received.
Payment of the Recruitment Start Fee constitutes full acceptance of the agreement, as stated in the source agreement with reference to Section 361 of Thailand’s Civil and Commercial Code. The number of positions covered is calculated at USD 1,000 per position: USD 1,000 covers one position and USD 2,000 covers two. Additional positions require payment at the same rate.
The Success Fee becomes payable once the selected Candidate formally accepts the offer and signs the employment contract. Before final selection, the Employer may review the CV, qualifications and available supporting documents, conduct online interviews, and review practical assessment results and/or recordings where available.
Candidate availability cannot be guaranteed indefinitely. Once an offer is accepted, the Employer should promptly proceed with the employment contract, documentation, visa/work permit procedures where applicable and other formalities to reduce the risk of the Candidate becoming unavailable.
All payments are final and non-refundable, except where mandatory law requires otherwise. By completing payment, the Client confirms acceptance of these Terms & Conditions in full.
3. Service duration
The service lasts a maximum of three consecutive calendar months from receipt of full payment and the required job information.
The service ends automatically after that period. Client delays, changes to the job offer, candidate withdrawals, visa procedures or interview delays do not pause, restart or extend it. Any continuation beyond three months requires a new written agreement and an additional fee.
4. No recruitment or placement guarantee
Nuad Thai School does not guarantee a minimum number of candidates; that a suitable candidate will be found or presented; attendance at an interview or acceptance of an offer; selection or hiring by the Client; a visa or work permit; or that a candidate will travel, start employment, complete probation or remain employed.
Results depend on external factors including candidate availability, market conditions, destination, salary, working hours, accommodation, benefits, visa requirements, the spa’s reputation and the overall attractiveness of the offer.
The absence of suitable candidates during the three-month period does not create a right to a refund, credit or extension.
5. Client responsibilities
The Client must provide complete and accurate information about salary, commission, working hours, days off, duties, accommodation, benefits, workplace location, contract duration and visa sponsorship.
The Client is solely responsible for interviews and final selection; verification of qualifications, references and documents; the employment contract; lawful and safe working conditions; salary, benefits, insurance, taxes and employment obligations; visa, work permit, immigration and governmental procedures; and travel, accommodation, medical, relocation and other employment-related costs.
Any allocation of these expenses between the Client and Candidate must be agreed directly between them. Nuad Thai School is not involved in or responsible for those arrangements.
6. Candidate information and employment
Assessments are preliminary professional evaluations and do not guarantee future performance, conduct, reliability or suitability. Candidate information may rely partly on documents and statements supplied by the Candidate. Nuad Thai School is not responsible for false, incomplete, undisclosed or subsequently changed information provided by a Candidate.
Employment contracts are concluded directly between the Client and Candidate. Nuad Thai School is not the Candidate’s employer and is not responsible for their actions, performance, resignation, absence, misconduct or breach of contract.
A Candidate introduced by Nuad Thai School remains an introduced Candidate for 12 months. If the Client, an affiliated company or a related business hires that Candidate directly or indirectly, the applicable recruitment fee remains payable.
7. One-time complimentary additional search
If an introduced Candidate starts employment but does not successfully complete the agreed probationary period, Nuad Thai School may provide one complimentary additional candidate search for the same position.
This benefit is available only once per paid position, requires unchanged job terms and written notification within five business days, and does not guarantee another candidate. It does not restart or extend the original three-month service period and cannot be exchanged for a refund, credit or another service.
It does not apply to visa or work-permit refusal, withdrawal before employment begins, changes to job conditions, Client breach, non-payment of salary, unsafe or unlawful working conditions, business closure or force majeure.
8. Liability
Nuad Thai School’s total liability arising from or related to the services is limited to the service fee paid for the relevant position.
Nuad Thai School is not liable for indirect losses, loss of business or profit, immigration decisions, employment disputes, or any act or omission of a Candidate after introduction or employment.
The Client remains responsible for claims resulting from the job offer, employment relationship, workplace, immigration process or misuse of candidate information.
9. Acceptance
By completing the online payment or signing the agreement, the Client confirms that they have read, understood and accepted all of these Terms & Conditions.
10. Additional offer: scope and precedence
The “USD 250 Service Fee + USD 250 Success Fee” package is separate from the standard package in section 2 and applies only when expressly identified in the accepted quotation or order. Existing contracts are not amended retrospectively. For this package, sections 10–14 override conflicting provisions in sections 1–9 concerning scope, fees, payment triggers, duration and the additional search. Other compatible provisions continue to apply.
The prices below are per vacancy. One order may cover 1–10 vacancies with the same role and employment conditions; different roles or conditions require separate orders. No additional cost or service is incurred on the Client’s behalf without prior agreement.
11. Service fee and success fee
A USD 250 service fee per vacancy is payable before work starts. It covers publishing the vacancy, application screening, preliminary interviews and presenting profiles identified as potentially suitable. It pays for work undertaken and team resources; it does not purchase or reserve any person.
An additional USD 250 success fee per recruited candidate becomes due when that candidate signs the employment offer issued or approved by the Client. Payment does not depend on a later employment contract, visa, travel or commencement of work. The Client must promptly report the signature and provide a copy. The 12-month introduction provision in section 6 continues to apply, with a USD 250 success fee under this package.
Subject to mandatory law, paid service fees are non-refundable if no suitable profiles are found, profiles are rejected, no hire occurs, or the Client cancels or changes its project. Once triggered by signature, the success fee remains payable and is not refundable merely because the candidate later withdraws, fails to start, is refused a visa, resigns or is dismissed. No success fee is payable without signature.
The Client retains all rights and remedies that cannot lawfully be waived. Non-refundability does not excuse Nuad Thai School from performing its own obligations or permit a success fee where the triggering event has not occurred.
12. Optional advanced practical massage assessment
At the Client’s request, an advanced practical assessment may be ordered for USD 300 per candidate per session, in addition to service and success fees. It includes a trainer, a model, the HR team, the practical test, video recording and an assessment report. It is not included in the USD 250 service fee and is commissioned only after the Client agrees and pays.
The session is subject to the availability and agreement of the candidate, trainer and model. The candidate and model must be informed of the recording’s purpose, recipients and retention arrangements, and their documented consent to recording and sharing with the Client must be obtained before recording. Covert recording is prohibited. If these requirements cannot be met before the session, the parties agree in writing on rescheduling or treatment of the unperformed option, subject to applicable law.
Once the assessment has been performed, its USD 300 fee is not refundable merely because the result is unfavourable or the Client decides not to recruit. Findings reflect observations on the assessment date and are not a regulatory certification or a guarantee of continuing competence, conduct or future performance. Recordings and reports are confidential and restricted to recruitment assessment; publication, advertising use or disclosure to third parties requires an appropriate legal basis and the necessary permissions.
13. Three-month service and reasonable professional efforts
The initial search lasts three consecutive calendar months from receipt of both the USD 250 service fee and the required vacancy information, whichever occurs later. Nuad Thai School confirms the start and end dates in writing. Any later success fee or optional assessment payment does not delay that start date.
Nuad Thai School undertakes reasonable professional efforts (“best efforts”) to publish, search, screen, interview and present available profiles. This is an obligation of means, not a promise of results. No minimum number of profiles, interviews or hires, or presentation deadline, is guaranteed. The no-guarantee provisions of section 4 continue to apply.
The Client freely decides whether to offer employment or hire. Each candidate freely decides whether to accept or reject an offer and remains free to leave employment subject to applicable rules. Nuad Thai School cannot compel either party to enter or continue employment.
The initial search ends after three months. Client delays, changes to criteria, candidate refusals and administrative delays do not automatically pause or extend it. Any paid continuation requires a separate written agreement. The additional search in section 14 has its own one-month period, even if the initial period has already expired.
14. One complimentary additional search for one month
If the recruited candidate resigns or is dismissed during the first two calendar months from the actual employment start date, Nuad Thai School undertakes one further search for the same vacancy for one calendar month, without a further search service fee. For this package, this commitment replaces the discretionary wording and initial-period limitation in section 7. It is not a replacement guarantee.
The Client must submit a written request within five working days of departure or dismissal, stating the employment start and end dates and the reason for departure. The additional month begins when the complete request is received; its dates are confirmed in writing. All fees already due must have been paid, and the vacancy, pay, location and employment conditions must remain substantially unchanged.
This benefit does not apply where departure results from unpaid wages, Client breach, unaccepted changes to employment conditions, unsafe or unlawful conditions, abuse or exploitation. It does not cover withdrawal before starting work, visa or work-permit refusal, elimination of the vacancy or business closure.
Both the search service fee and the success fee for the first replacement are waived: no further USD 250 service fee or USD 250 success fee is payable if that first replacement signs as part of this additional search. This waiver overrides section 11 and does not cover a separate additional hire. The commitment is to resume searching, without guaranteeing a profile, signature or commencement of work. It cannot be exchanged for a refund, credit or successive renewal. A further advanced assessment, if requested, remains a paid USD 300 option.
15. Ethical recruitment and prohibition of human trafficking — all packages
Nuad Thai School and the Client prohibit human trafficking, forced labour, debt bondage, threats, deception, sexual exploitation and recruitment of minors for these roles. Recruitment confers no ownership, personal control or right to coerce a candidate. No contract provision authorises, conceals or excuses such conduct.
Before acceptance, the Client must provide an accurate written offer, understandable to the candidate, reflecting actual conditions, and comply with applicable pay, hours, rest, safety, freedom of movement and termination rights. The Client must not retain passports or personal documents, impose security deposits intended to prevent departure, or threaten workers to compel them to remain.
All fees charged under this service are payable by the Client and must not be passed directly or indirectly to a candidate through debt, wage deductions or exit penalties. Recruitment fees and related costs are borne by the employer and must not be imposed on workers. This overrides any conflicting wording in section 5.
Each party remains responsible for its own legal obligations. Services may only be performed in compliance with applicable licensing, authorisations, international recruitment procedures and immigration rules in the countries concerned. This agreement is not a recruitment licence, visa or work permit and does not waive mandatory authorisations.
Where credible indications of abuse, deception or illegality arise, Nuad Thai School may suspend introductions and request evidence. If serious misconduct is established, or refusal to cooperate prevents verification, it may terminate by written notice and cooperate with competent authorities as required by law. Treatment of paid amounts remains subject to mandatory law and services actually performed.
16. Liability, confidentiality and mandatory rights — all packages
The exclusions and liability cap in section 8 apply only to the extent lawful. They do not exclude or limit liability for fraud, intentional misconduct, gross negligence, trafficking, forced labour or any liability that cannot lawfully be excluded or limited. Nuad Thai School remains responsible for performing its own obligations; its intermediary role is not a blanket exemption.
The Client is responsible for the consequences of its own breaches, including employment conditions, wages, safety, immigration and data misuse. To the extent permitted by law, it indemnifies Nuad Thai School against third-party claims and reasonable evidenced costs directly caused by those breaches, excluding any portion attributable to Nuad Thai School.
Profiles, contact details, documents, reports and recordings are confidential and may be used only by authorised persons for the relevant recruitment. Each party must fulfil its applicable data-protection obligations, including notice, legal basis, security, retention and international transfers. Disclosure to an affiliate remains subject to those obligations.
Sections 15 and 16 override conflicting earlier provisions for new orders that accept them. If a provision is invalid or unenforceable, the remainder continues to apply to the extent permitted by law. Changes to an existing contract require agreement between the parties; later publication alone does not amend it retrospectively.
